May Visa Bulletin is out. EB3 ROW and Philippines seem to have moved by 1 year.
"Recent discussions have indicated that both the Citizenship and Immigration Services (CIS) and the Department of Labor still have a significant amount of cases in their backlog reduction efforts. As a result, the anticipated increase in demand has not yet materialized and may not for some time. Therefore, in an effort to maximize number use under the annual numerical limit, the Worldwide and Philippines Employment Third preference cut-off dates have been advanced by one year."

Since EB2-India is current, I am exploring the possibility of interfiling.
Goal: Interfile in such a way that my new application under EB2 (New case
category) get attached with old case (EB3) priority date (07/2003) and
thus enable me to take advantage of EB2 current PD as declared in
April 2008 bulletin.

Today I got a call from an officer in "immigration and customs enforcement" asking for an appointment to visit my residence for checing my immigration status.
I am on H1B visa.
I would appreciate if someone could give any sort of information related to calling for a home visit.

Further to my above post, I have following questions
1) Once the client side project is completed (assuming the employer is paying to employee), how much period we can stay waiting for a new project? Is there any limit of the period?
2) Once the pay from an employer is stopped, with in how much period, one has to go to home country? Is there any limit?
3) Can an employee stay (assuming he is getting paid) with out client side project and working on skill upgrade and waiting for a new project?
4) What are the documents I should be ready with? I am staying with my family.
I have following documents with me:
a) LCA,
b) Passport for me and my family
c) valid visa recently stamped for me and for family
d) approval notice,
e) employment offer letter,
f) clinet appreciation letters print outs,
g) past experience letters,
h) all pay stubs for my period of stay in USA.

I called USCIS NSC yesterday and asked if my new approved I-140 was interfiled with my pending I-485. The IO asked me for my A# and then told me that she doesn't see the new I-140 starting with SRC on the system. She only sees the original I-140 with the LIN. It was very frustrating to hear this as I had called NSC a week before and the IO told me that the new I-140 is in the system and visa was available for me. However, I remembered that last week the IO did not ask me for my A#. She only asked for the receipt numbers of my pending I-485 and the new I-140.
Friends, what else can I do to make sure that my newly approved I-140 under EB2 is interfiled?

Folks,
Per lawmaker we recently met(WA state), it is imperative that we also get our message across to lawmakers in the midwest and south.
Due to resident strength and businesses employing H1B people(who end up getting stuck in retrogression) in the west and east coasts and large metropolitan cities, the lawmakers in these areas are slightly more aware of our issues. They also get funding from local companies that employ people stuck in retrogression.
However, representatives in the MIdwest and South do not get a lot of funding from local businesses that employ H1Bs and have other local issue that they would rather pursue(agriculture, etc.).
It is imperative that awareness is spread in the midwest and south !!

Congrats suresh..it's good to see Dec 05 getting approved..best option would be to get your wife here on F1..Some of the schools required only TOEFL ..after coming to US get married again in US and apply for 485..if she is currently working in india..u can try L1 too....ofcourse for H-1B u need to wait for one more year..i don't think US embassy in Chennai will get to know u got married unless she tells them..there is no fraud or anything in this..i believe it's like..don't ask, don't say..ur not cheating anyone..trying to find a small loop hole for a very good reason..

Highly suspicious. I would call ICE and confirm. Also, I would ask this "officer" to visit at the workplace in presence of your lawyer. No one has any business visiting your residence for enforcement of a work-related visa. Be careful; consult with your attorney before entertaining any such request.

Does anyone know how Quebec compares to Ontario. Specifically Montreal to Toronto. Economically, culturaly, etc.?

I would say Ontario (Ottawa or maybe Toronto) is better compared to Quebec with regards to immigrants.
In Quebec, if you cant speak French, you are frowned upon. Yeah, yeah i can hear the Montrealers saying they speak both French and English, but the reality is that Quebec only likes people who are French. I heard some racist remarks while walking in the downtown, not uncommon. For some ignoramuses, every colored person is a "bangladeshi" and hurl racist abuses. I was very shocked to say the least...Isolated incident, but not uncommon.
Bottomline, if you wanna life like u had in the US, better Ontario than Quebec or even BC.

Hi,
I am planning to accept an offer from a company that will also sponsor my H1. All the terms & conditions look fine to me and their seems to be no bond.
However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.
"Employee acknowledges that the Company may invest significant sums to train and educate Employee and the Company�s investment in Employee would be jeopardized if Employee were to leave the company�s employment prior to the Company�s receipt of the benefits of such training and education. Employee hereby agrees to refund to the Company all amounts expended by the Company in the immediately preceding 12 months for education or training of the Employee if Employee resigns from the employment with the Company or is terminated by the Company for gross neglect of duty, material breach of the Letter or this Agreement or conviction or plea of guilty or no contests to a felony. Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. The payments will be due within 30 days of
termination of the employment."
In my company if they transfer you with-in company and pay all moving which can total to 25-30 k, they say that if you leave with-in 12 month of moving you have to pay back moving expenses. If company terminate you before 12 months, they will move you back and pay for your expenses.
It may be a standard clause if it is only valid for first 12 month. May be they spend $$$$$ on training but i am pretty sure they'll have hard time enforcing it.
