    Sen. Charles Schumer (D-N.Y.) maintained Wednesday that Congress will tackle comprehensive immigration reform this Congress, and perhaps even this year.

    �All of the fundamental building blocks are in place to pass comprehensive immigration reform this session and, even possibly, later this year,� Schumer, the No. 3 Democratic leader, said during a speech before the Migration Policy Institute.

    Schumer, chairman of the Judiciary Subcommittee on Immigration, Refugees and Border Security, outlined key principles that must be part a reform bill, including strong enforcement of illegal immigration, an employer-based verification system and a direct path to citizenship.

    The Democratic Conference vice chairman, who will join a group of lawmakers at the White House on Thursday for a summit on immigration, underscored �the intensity for solving this problem once and for all� this year. Majority Leader Harry Reid (D-Nev.) has similarly suggested that immigration must be tackled sooner rather than later.

    �I have no doubt that President Obama has an unyielding commitment to achieving comprehensive immigration reform,� Schumer said. �And I truly believe that his leadership will be the critical difference in getting us over the hump this time around.�

    Schumer said the last legislative attempt in the 110th Congress failed because it wasn�t strong enough in clamping down on illegal immigration. This year, he said, that issue must be a top priority.

    �I think on the part of the left, there�s an understanding that unless we convince American we�re going to be really tough ... it�s the only way to do it,� Schumer said.

    With Republican losses among immigrant voters in the last election, Schumer said the GOP has an interest in moving on a reform bill as well.

    Reid said Tuesday that immigration remains a top priority this year � just behind health care reform and climate change legislation. He said he has spoken with White House officials on the matter, and despite a packed schedule that includes appropriations bills and a Supreme Court confirmation, the Majority Leader said he has the votes and the support to take on another complex issue this year. Obama, for his part, has said he wants to get negotiations rolling on immigration but hasn�t laid out a timetable for passing a reform package.

    In my case my GC sponsoring employer had consent signed from me before filing my GC that- I need to work for them for 1 yr at least after getting my GC. Otherwise I need to pay them all legal expenses they have spent on my GC process if I leave them before 1 yr.

    Is this legal? my employer is top 5 IT firm. (Big pockets to fight anything like this)

    I guess most of the folks here are busy preparing to apply for 485. I have different problem here.

    My employer's attorney is charging me outrageous fees of around $5000 to
    apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.

    Do I have any other options. How much do they charge usually.

    Get a approval notice for I-140 and file I-485 urself, if I-140 not approved then get the receipt number and file urself

    We have received information that the Comprehensive Immigration Bill will be voted soon and the bill will be closed for amendments on Wednesday. That leaves only 2 working days to get something done

    The text for the bill was only released in the evening on March 28th

    As you have seen from the document released by IV that H2A workers will now be able to get citizenship in 11 years and self petition themselves. But legal skilled workers
    1) will not be able to self petition
    2) the wait to citizenship as it stands today is definitely more than 11 years
    3) and all the left-over visas from EB1, EB2 and EB3 will now go to EB5 category

    We really need to make sure that everyone is aware of the unfair treatment meted out to legal skilled immigrants and will be doing the following

    1) We will be putting up webfaxes to send to senators asking for similar treatment to legal skilled immigrants too. They should be up by 5.00 PM EST. Make sure you login and send a webfax ASAP.

    How can I send the fax?

    a) Login,
    b) click on the 'Home' link on the top of the page,
    c) then click on the 'WebFax' link on the left hand side menu options,
    d) enter your information,
    e) Select webfax # 10 and #11 and your state
    f) Send the fax


    2) We need to contact each and every company like Microsoft/Intel (and any other to which IV members belong) that depends on skilled immigrants for their functioning. We need to make sure that their HR and CEO know about this.

    a) If you are not comfortable with speaking about this to your HR/CEO (and we don't see any reason why), please send us the email id of the right person in HR and your CEO. We will not put your name anywhere but send a polite email to them on behalf of Immigration Voice. We will NOT spam them (just a single email) and will not name any person in the email. Remember that this is just to get their attention so that they can do the right thing.

    4) Last time we sent about 385 faxes. This time 385 will not cut it. We need atleast a couple thousand faxes to get our job done. We need every member of IV + spouse and much more to achieve the kind of deluge we intend. Get atleast 5 new members to IV. I am sure most of us can call up atleast 5 more friends who might not know of IV but will be affected by the above. This may, for all practical reasons, be the final push from IV and we need as much support from everyone as possible.

    Hi,
    I have got a job offer & this employer has few pre-approved labors which he offered me if I join him.

    I am on H1B visa since 3.5+ years & I am looking for the company to get my GC as soon as possible. I have BS + 10 years of IT experience in India/ USA/ UK, as Software Engineer/ Solution Architect / Project Lead/ Project Manager / Sr. PM etc.

    I want to know :

    1. Is it possible to use this pre-approved labor for me... if I have all matching skills & experiences to show in my resume (experiences/skills gained before that approval date of that labor)...? This approved labor shows the name of their previous consultant.

    2. Is it necessary to file the labor substitution by the employer...if I want to use that approved labor...?

    3. Is it possible for this employer to directly file my I-140 against this approved labor...?

    4. What are the info/proofs to verify that this employer is really filling my I-140 against this labor... ? (This employer has their attorney & I could not have better communication with their attorney)

    5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

    Please let me know as much as info/ guidance you can provide to me.

    Hi, you need lawyer for your first 3 questions. For question 4, you need to ask for copies of 140 petition and 485 petition and labor substitution. If you cannot be strong and ask for it, and take their word, then you will constantly live in doubt and it will be really really bad. Negotiate with them that you will need copies of everything that goes into USCIS and comes out of USCIS and you want your own attorney to handle all that. Otherwise its not worth it. You will put yourself in vulnerable situation without your own attorney doing all the work. If you choose to trust them now, and go along with it(their lawyer, their control), 6 months from now you will be in a worse situation than most of the other guys here who are stuck in 3-4 years of retrogression. Dont ask me how, trust me on this one. I know the tactics and methods of such employers very very very well.

    For questions 5, I think its legal for employers to ask employees to pay for USCIS fees and lawyers fee if the employee quits before GC is approved.

    Other than that, you will find a lot of hatred from this forum as what you are doing is very much inflaming since you are cutting in line -- legally so -- but still, its cutting in line. So dont be surprised by that.

    Good luck and make sure you get your own lawyer(that your are paying to) to do everything about your H1, Labor substituion, GC etc.

    Its very very important to discuss this with your future wife. If your marriage starts with telling a lie, IMO, its not a good sign. Whether its good or bad, just talk to her and discuss the best available option.     As everyone knows that AOS for those who already in US and CP is for those who are outside US (theoretically). It is a personal choice for a person in US to file either 485 or opt for CP. The reason for CP was a popular choice due to 485 processing delay between 2001 and 2005. Between 2001 and 2004 all EB categories were current for all countries. No one heard of term retrogression in that period. No one was worried about EB2 or EB3. However due to severe processing delay (partially due to increased security check due to 911) in 485 applications during that period, it was taking about 2 years for 485 approvals. During those entire 2 year period visa numbers were current and did not fluctuate as it is happening now. Therefore people opted to go for CP, as US consulates in abroad were not busy. They scheduled the interview right away as PD was current for all categories, during that 5 year period. That�s why CP was popular choice that period. Now, in the retrogression climate and continuous fluctuation in PD (back and forth movement), opting CP is a blunder mistake. Furthermore, now (at least before July 2007 fiasco) 485 approvals are so fast. If PD was current, USCIS was approving 485 with in 2 months before July 07. Therefore one should not even think about CP, if already in US unless if you are in EB1 or EB2-ROW category. Therefore 485 is the only option available to enjoy subsidiary benefits like EAD/AP/AC21. If any one already filed CP, to switch back to AOS they must wait till visa number available to their PD again. It will be a long road, and it complicates. As already mentioned, there is no technical ground to award EAD/AP for CP persons if already in US. If IV goes and talk to USCIS, they will laugh. To achieve same result, one can lobby for administrative fix like awarding EAD/AP for a person whose 140 was approved and legally present in the US in a valid non-immigrant status. This may be possible.
