Got EAD Card for all of us in a span of 3-5 days. My son got 1 year EAD (10yrs old) but me and my wife got 2 years EAD. Any way happy that I can claim 300$ tax rebate for my son and get SSN for him also..

however, I have some questions. You say that the officer told you that your AP was approved on Oct 1, 2007. Did you see a LUD change that day in your status. If you did, what did it say. I ask because I got a LUD change on our AP on Nov 2 but the message is still the same as it was when i got the receipt notice. No mention of AP approved.
Ans: Yes, I already mentioned that in my write up. First (and only)LUD change happened for me on 10/1*/2007 and that is the approval date as per lady officer in USCIS. During LUD change message content never changed for me and still it is the same which is as under. so currently I have not received physical AP papers yet and on line status still does not show our AP aaproved yet I found our APs are approved during this infopass appointment.

That's true. But if there is G28 attached to your I 485, then the attorney can act on your behalf.
As per my understanding, Lawyer or employer can not withdraw I485. I may be wrong, I 485 can be only withdrawn by applicant.

Sorry to hear about your personal life. If you and your wife agree for filing a divorce petition together, you can file for divorce by mutual consent in India. Both of you have to be present in the court when you file. The judge will decide on the case after a wait time of six months and you may have go back again for the final judgement. There is an one-year separation time that is required before you can file for mutually consented divorce in India. If you are already separated for more than a year, this is the best route.
If not, like some one else mentioned, you can file here but, some states like NY don't have provisions for divorce based on mutual consent or irreconcilable differences. So, it will take up to a year sometimes. It is perfectly legal and valid to get a divorce in the U.S if both of you have signed the petition and have been present at the court.
Your PD is Dec 2003 and so, you have time especially with all the projections that the EB3 quota (India) may retrogress.

In fact, I got laid off recently, my LC gone, which was filed on Sep,2004. I am looking for job again on my 8th year H1B extension. In this uncertain future it is better to return home for me.
I was in similar situation last year, I got layed off after working for 5 years in same company and was on my 6th year h1b with eb3 L/C pending in BEC. I switched to consulting immediately and got extension based on the old L/C and applied for new GC.
These are situations that are not under our control. We must live with these FOL

I read on USCIS website update on Sept 28 that CSc is assisting TSC to enter the applications. My transfer notice states that application is still under TSC/ But I am also not sure which center will finally process

Hi,
Filed at NSC on Jul 21st. Received as per FedEx receipt on Jul 23rd. Transferred I-485s, EADs and APs applications from NSC to CSC.
Received EADs and APs on Sept 25th from CSC.
Sept 18th notice received that I-485s have been moved back from CSC to NSC.
Rceipt date for transfer notice is Sept 18th. Dont see my actual Jul 23rd date anywhere.

Has anybody heard the story of the canadian skater who was allowed to become a citizen in an expedited manner (she had one more year to go before meeting the 5 year criterion for eligibility after GC) just before the olympics. Actually, I think she won a silver medal at the olympics for the USA.
Anyway, from what I hear, she had gotten her GC in 2002 and had been living and training in Detroit with her american skating partner. When she decided to participate as an american, but was not elibible to apply for citizenship until 2007. So, she contacted a lobbyist to help her with her case. The lobbyist was able to convince a michigan senator (not sure who this is) to help. The story is that the senator was able to include a measure in the bill signed by the President in Dec to make it legal for people in the situation such as the skater to apply for citizenship even when the 5 year period is not complete. The measure got passed when the president signed the dec bills.
So, they filled her application, got the immigration services folks in Detroit to come out during the chrstmas holidays specifically for her, and got her the citizenship in time for her to get her passport for the games.
So, my point is...if it is legal for the lobbyist to help her (a non-citizen) with her immigration case and it was legal for the senator to introduce the measure, why would it be deemed illegal to do what we are attemting with our lobby firm and our efforts to meet and talk to the senators and congress people?

Looks like for July 2nd they just started and i talked to 5 other guys( who got receipt) - all of them has a sending time between 9 and 9:30 AM by FEDEX
Mine went around 11:30 by USPS on July 2nd - so i have to wait for at least 2weeks. 1 hr late means 1 week delay !!

In the mean time a random passer by like yourselves comes along and stirs the pot again, when the fire was just about to be extinguished. If you don't like my argument, debate it, we all love good debates here and most often we learn from each other. Don't just attack. My only and last post on this topic.

I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.
Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!
biostatistician job position can involve analysis of biological data. That qualifies you still as a biological researcher. Biological researcher is a very very very broad term working from bacteria to human genetic diseases; deep sea fish to suspected life forms in asteroids and space debri (astrobiology). It is basically a straightforward description of what you are going to do as a biostatistician and justification of how this will still qualify you as a biological researcher. That makes it very much job specific: if you are going to use statistical methods to analyze GE's cat scanner machine performace it would not be biological research, but if you are going to use some statistical methods in analyzing cat scanned body images and tie your analysis to clinical conditions it would. If you could post both your current job description in your gc application and the prospective biostatistican job description as you see, I can try to help you.

What I don't understand is it's not mandatory to inform the USCIS about moving to a different job via AC-21. If you are not required to inform them, then where does the question of AC-21 approval arise ?

They change this number later in the year, since some of the FB visa allocated are retruned back to the pool (if the person getting GC does not enter the country in specified time).
They allocated a huge chunk of EB2 Visa to South Korea 7125 (currnet all through the year). Same with EB3 SK got 4727 (close to sum of India and China).
So i agree things will move slower this year but still move forward. We will not see an EB2/3 India/China Current any time soon unless they screw-up again like july 07.
