I understand your frustration since I am in the same boat but I feel it is wrong to say that the IV efforts are hurting EB3 folks. Not sure if there is basis to support that. Several IV proposals helped all EB categories and failed mainly due to anti-immigrant lobby.
EB3 situation is completely hopeless and only piecemeal reform can help EB3. I am sorry but I do not understand this discussion since this bill (if it ever comes to debate) impacts across all EB (advanced degrees).
Now why would i sue IV. It is the organization which is making an effort. Sadly that effort is hurting EB3 folks. The whole idea is that we are a community and as a community we need to discuss all issues. Now when i talk about EB3 issues a EB2 volunteer (I commend you for doing what you are doing w.r.t. advocacy) asks me how many law makers did i meet. Now that the amendmendts from Senate side have been defeated, what is the latest from House? Do we keep calling CHC members or we have another plan of action? I think the front page needs to be updated.

USCIS has already made everything 'U', starting with August and this year's quota is finished. Also now they have a little advantage that everyone who can file I-485 will file it. They now have all the applications and all the numbers to calculate for next few years.
Don't you guys think that the USCIS will probably keep on moving the dates by as much only to accomodate the quota numbers.
Also, BEC has targetted Sep '07 to clear all labor backlogs and new I-485 approvals won't start before Oct '07. Older PDs will (as they always had) have golden value.
Once bitten twice shy, USCIS will not make the mistake of making dates 'C' in a long time.
2006-07 filers have intermittent releif of EADs which BEC or pre-PERMs never dreamt of :) (that includes me)
This is what looks logical and this will do justice to all.

Can you give me some reasons why visas are unused and a percentage.
In other words, why would someone go through all the paperwork and then not get the visa?
no idea why visas go waste? The annual limit of 140,000 is use or loose it. Processing delays is main reason visas are wasted every year.....

My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.

Have you tried to reach the CIS via infopass? 'Aging out of children' is one of the extraordinary situations which can force the hands of CIS. It is on the USCIS guidelines. In your case, you can ALSO go to your congress members to look into this. Extraordinary situations require extraordinary responses. Good luck.

So far, there is no provision of 485 filing without priority date becoming current. Has this failed too? Just two weeks before Feb. 15th. I guess the fate of this provision is determined now.
It seems that nothing can happen before Feb. 15th. Even the H1 increase has not happened yet. Democrats do not seem to be immigration-friendly as many expected before. No hope for CIR this year. No hope for SKIL this year. What a miserable situation!

Hi,
My labor certification was filed in Dec. '06. Since its date of filing, the online case status was showing as "in process". However, on 07/20/07, last week, the status changed to "case denied".
1) What are the next steps?
2) Do I need to refile the labor certification. If yes, how soon can it be done?
3) Can it be filed for the same position or it needs to be filed for a different position?
4) Should I find a new employer to file for labor certification as my current employer could not get my labor certification approved or I should stick with this employer itself and file for a new labor certification?
Please help me out.

What is? Working on the July submitted apps ahead of the ones already in the queue?
They wont work on it, they just accept it. FIFO (First in- First out) Priority date is always going to be the order. So, Camarasa, your older priority date will be processed before EVERYBODY Else w/ latter Priority. Dont worry.
