Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?

If your Notice date is in Sept 2007, we need to wait for our turn. Look for the NOTICE DATE on your 485 application.

I was thinking on the same line. Why to wait at the last moment and that too when today they allowed the medical examinations to be done outside the local area. I guess, time to chill out, have some beer (i'm already having) and worry on monday. We anyway can't do anything about it on sat-sun.

-If you "front desk" the application, i.e. decide it is futile to file, and

chances of utlizing whatever fix might be available.
-If you do submit the adjustments, be sure to use a method whereby you can

-AILF's Legal Action Center is seeking plaintiffs with respect to both the

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

If you have evidence of a specific I-485 case that you feel was erroneously denied due to USCIS not adhering to AC21 guidelines, we kindly ask that you please forward us a copy of your denial notice or provide further detail as to the reasons for the immediate denial.
Please submit information via email to cisombudsman@dhs.gov with the subject AC21 Evidence of Immediate Denial. In addition, for protection of privacy we ask that you please omit any personally identifiable information such as names, a-numbers, case numbers, etc.

It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.

Anyone have any ideas on what EB3 Rest of World will be in the October Visa Bulletin. My Priority date is OCT 2005 EB3 Rest of World. Do you think I have a long wait?
I believe you wait will be predicated only by processing delays.
Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?
USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.
But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?
Yes, at least one immigration attorney disagrees with the current interpretation, however he feels that the laws, as written, gives USCIS/DOS the wiggle room to deflect any lawsuits. Since the law does not deny EB3 the numbers, I think we should start a letter campaign to bear upon USCIS/DOS to take a second look at the law and fine tune their interpretation.
We should also ask other immigration lawyers their thoughts (some who have online chat/discussion).

I had the same issue...
Here is the short version of how it unfolded. I've seen some quick responses from USCIS.
9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number
I was pleasantly surprised with the fastness of USCIS.

My attorney's office contacted USCIS and was told that USCIS has current address on system :cool: They told that since the case is waiting for RFE it must have happend by mistake :confused:

Let us start this campaign. Please DO send letters. As we also have IV support now, let us get a resolution for this issue with the help of IV leader ship..
This will help people who are already affected due to these denials and aviod denials for other people going forward.. Printing and mailing the letter will take only 10-15 mins of your time..This campaign will be a sucess only with support from every one.

Just talked to a recruiter from a software giant.
She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.
Folks, we should not remain quiet about this. The regulations make it illegal for an employer to discriminate based on immigration status. We should politely and respectfully pursue the authorities regarding this matter.
I would encourage you to point out the USDOJ guidelines (posted earlier) to the "software giant" employer and also contact the OSC worker hotline.
Also, would it be wise for people to post name of the company who are known to have such policies? We got one - CapitalOne from earlier posts.

I think it is the part of their process. I went an infopass the other morning and the IO gave me the same response. She said every thing was fine with my application. It was pre-adjudicated and now waiting for a review now that my priority date is current. She asked me to wait for 60-90 days. But I got the approval same afternoon :)
I was told the same thing in my infopass appointment on Sep 3rd. I also opened a SR on 09/01. Finally received the 485 approval notice on 09/10. My wife who is my dependent actually received a CPO email on 09/09 and a message on 09/10 saying "you are registered as permanent resident". I never received the CPO email and I don't care.
It's been a long 10 year journey, extremely frustrating. I case to this country as a student, then H1B, was exploited by my employers for so many years, still with the same employer on H1. Renewed EAD 2 times never used it as my 485 was denied last year.
Case history:
Priority date: Apr 26, 2006
140 rejected: Dec 2008.
I-140 reapplied Jan 2008
I-485- receipt date: 09/11/2007
I-140 approved Aug 2008 (Multiple RFEs which were never ending)
I-485 denied without appeal Jul 2009 because they somehow linked my case to a denied I-140.
Lawyer filed motion to reopen in Aug 2009.
I-485 reopened and went into pending status Jun 5, 2010
Here's what I did since the last month:
- Called USCIS to open a SR 08/15/10 but was told I should call when my priority date becomes current
- Called USCIS on 09/01, opened a SR for both myself and wife, was told I should hear back in 30-60 days, but may receive an email sooner.
- Lawyer called on 09/02: IO (Level 2) said, I may have to do finger printing again as they were expired.
- Took infopass for 09/03: IO was very helpful. Said my case was in transit and is pre-adjudicated. It was not assigned to IO as of that point.
- Contacted Congressman on 09/07. They initiated an inquiry on my behalf.
- Took another infopass on 09/10 (I wasn't aware that petition was already approved). Received the most humiliating treatment from the IO. She will not disclose any detail and told me I should come back in Dec to check on my status since my 485 was denied earlier. I ran into a Canadian immigrant who had the same experience - absolutely useless.
- Came home all frustrated and angry. I was surprised the see that the approval emails had popped in 8 am in the morning.
I believe the SR to request our files on 09/01 probably worked.
I can't thank enough the IV core and all wonderful people who keep contributing to this forum. This forum has been a great help!
