Yeah some forget to be civil...but i believe that these few don't represent all of of IV.
And we are all subject to emotions and can make these mistakes as well where we forget to be civil.
I agree there needs to be more clarification on IV's goals and current pursuits....coming soon....a better FAQ page ;)
Correct, I don't represent IV. But here is my observation. Every time some one gets a response from ordinary members such as myself, these members asking so called "legitimate" questions, these members such as bitzbytz, rajuseattle et al, these guys will immediately cry foul, uncivil, being manhandled, abused and battered. If you want to have a debate, be prepared to handle the debate and don't pretend that you are melting when someone tells you that your idea is foolish. Either you want a debate or you don't. And if you want to have a debate then why not come up with a response in support of your arguments instead of engaging in name calling like "uncivil" etc.
I know when someone is asking a genuine question. Its no rocket science and I can tell when someone is genuinely asking a legitimate question and when someone is trying to throw mud on work done by others. It enrages me to see these people not doing anything but at the same time, damaging work done by others.

If USCIS is planning on using up all 40K by July 2, and not accepting applications why would they put out a memo like this?
questions are never ending, the only thing in our control is to push our lawyer to file asap.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

i am not baniya... in fact i lament the fact that i am not a baniya... i am a pure bred brahmin with high education, my entire family is highly educated till my family tree can be traced... they are all people who did noble things for God, kings etc... but i am aspiring to be a big time baniya... this last century and present time is a capitalist period... baniyas rock! they rule! if i had wealth, i would never share it... i will simply find ways to make other people slightly happy so that they keep buying my products/services... hail baniyaism

If the certificate doesn't have your name, how will they know it's your birth certificate? :confused:
I don't think birth certificate without your name is acceptable by USCIS
Usually they give saying baby girl was born to the following parents on this date at this place. because at the time of birth the baby may not be named.

...I think a great deal depends on the person at the counter at InfoPass, or the one on the phone in case of NCSC.
I took infopass this Monday at the local Chicago office. The guy basically said he cannot do anything...also said they cannot do anything even if I don't receive the card after 90 days. I then had an SR filed yesterday afternoon by calling NCSC...in this case the guy was nice and he even included my wife's EAD app info on the SR.
EAD e-filed: May 27th
FP: June 19th
First card production ordered email: June 28th
Second card production ordered email: July 29th

I don�t know what is so hard about this deadlock. Don�t they know that if:
1. Illegals are given temporary visas for them to return after a number of years, no-body would come forward. The illegals would see this as shooting themselves in the foot. They would prefer to remain in the dark and live here permanently. Purpose defeated.
2. A tough enforcement only bill is passed, with the hope that there would be attrition after a while: How long would it take for all 12 million illegals to finally leave? 1 million per year? 500K per year? 24 years? Yeah right! Ok assuming they leave at a rate of 500K per year (which I know wouldn�t happen) what would be the rate of inflow of more illegals?? What would be the balance of illegals after say 10 years? Think about it.
3. Give them a path to citizenship. Well they are here anyways but this idea might jeopardize the bill.
So my proposal is: Since �a path to citizenship� is the major road block to this bill, make a law that gives the Illegals an opportunity for GC but include in the law that �Anybody that ever comes into the country illegally CAN NOT become a citizen�. i.e they can get a green card but they can never be eligible for citizenship. I am sure this is a reasonable middle ground�. a path to PR but not citizenship. I am sure those illegals don�t care about citizenship anyways. They just want to be free and be mobile.
Just my thots.

As you might be knowing currently there is backlog for green cards. Unless some rules are modified you and me will not get green card in next five years. Specifically it is much serious condition for people from India, China, Philippines and Several such other countries. As they send lot of highly skilled immigrants and each country have fixed quota for employment based green card.
I know some of you have not yet started working on your green cards. But when you will start, you will realize that it is like doing another master or Ph.D. !!
Above group is formed by people who came here on student or H-1B visa. They are trying to fight for immigration reform for highly skilled immigrants. When you read or listen any thing about immigration you listen only about undocumented or illegal immigrants. No one talks about improving immigration situation for employment based highly skilled immigrants. Those very few from the business group who talks about highly skilled, are only interested in increasing H-1B, so that they can get more educated employees. But if you work on H-1 you will know H-1B has several limitation like inability to change employer, spouse can not work etc. So it is very important to get Green Card as early as you can, if you are on student or H-1b visa.
In current situation even if you are wise and quick enough to decide to act quickly for green card, you can not do any thing except sending papers to USCIS ( INS) and paying their fee and wait endless till you get frustrated and depressed. If you are waiting for your green card you already know it. If you have not you will know it soon. Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )
Employment based green card for highly skilled immigrant fall in EB-1, EB-2 and Eb-3 categories. Even if you have PhD and university job , you do not qualify for EB-1.
and that is only open category. For Eb-1 you need tenure track appointment at University with several years of experience, around 20 research papers and several international awards etc. Those who apply for Eb-2 or EB-3 or NIW ( national interest Wavier) should not hope for green card in next five years under current situation
This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.
I urge you to take look at their website. I am sure you will be impressed by the work they have done in last one year for highly skilled immigrants. They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor. This is right time for you to get involved with your future green card process by supporting this organization so that they become successful in their mission.
Before you go through their entire website, I want all of you to register just as a member. So that they can increase the strength of organization. You all might be knowing that In Washington D.C every thing works based on two numbers, votes and economical. That is why when you listen any thing about immigration you always listen about illegal immigrants, because they are in large numbers and are related to several others who are potential voters. Business group also favors them because of economical reasons.
So this organization of Highly skilled immigrants also need your support as member, to show law makers that it represent several thousand highly skilled immigrants.
(we don�t need to be in millions !!) So before you go through their entire website just register as member. It will not take more than a minute.
I also want you to visit this web site regularly, so that you are aware of what is going on in Washington DC in your favor or against, in reference to your future green card or US citizenship. I visit this web site ten times a day. They give minute by minute picture of the show in Washington DC when it is Hot. Also you need to be part of their email, meet the law maker and other activities as per your time convenience.
Let me add they are doing all the LEGAL activity which is fully permitted under US immigration Laws. Still if you have any doubt you can call them to clear your doubt.
Also they need what ever financial support you can do to them. I am also the financial supporter for them. I have contributed few hundred dollars and registered as monthly contributor. I want them to succeed for my, your and future highly skilled immigrants benefit. Remember they are fighting for our green card, which will give us several more rights compare to our current immigration status. It is better to contribute to them rather than paying several thousand dollars to the lawyers. Lawyers just fill forms (you need to check that three times before submitting !!!) and never promise to get you anything. This organization, I am sure with your, mine and other members support will get lot of work done in Washigton D C. So that probably you will not need lawyer for your green card application, and it will become very easy for you to file for Green Card. They had done lot more than what they promised. You can dig in to their website for making your self educated about there fascinating work. Let me add the core team which run this volunteer organization has spent several thousand dollars from their pocket to make this attempt successful, They are that much committed to success and final goals of organization.

Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )
Employment based green card for highly skilled immigrant fall in EB-1, EB-2 and Eb-3 categories. Even if you have PhD and university job , you do not qualify for EB-1.
and that is only open category. For Eb-1 you need tenure track appointment at University with several years of experience, around 20 research papers and several international awards etc. Those who apply for Eb-2 or EB-3 or NIW ( national interest Wavier) should not hope for green card in next five years under current situation
This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.
I urge you to take look at their website. I am sure you will be impressed by the work they have done in last one year for highly skilled immigrants. They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor. You all might be knowing that In Washington D.C every thing works based on two numbers, votes and economical. That is why when you listen any thing about immigration you always listen about illegal immigrants, because they are in large numbers and are related to several others who are potential voters. Let me add they are doing all the LEGAL activity which is fully permitted under US immigration Laws. Still if you have any doubt you can call them to clear your doubt.
Also they need what ever financial support you can do to them. I am also the financial supporter for them. I have contributed few hundred dollars and registered as monthly contributor. I want them to succeed for my, your and future highly skilled immigrants benefit. Remember they are fighting for our green card, which will give us several more rights compare to our current immigration status. It is better to contribute to them rather than paying several thousand dollars to the lawyers. Lawyers just fill forms (you need to check that three times before submitting !!!) and never promise to get you anything. This organization, I am sure with your, mine and other members support will get lot of work done in Washigton D C. So that probably you will not need lawyer for your green card application, and it will become very easy for you to file for Green Card. They had done lot more than what they promised. You can dig in to their website for making your self educated about there fascinating work. I paper filed EAD to AZ drop box on Mar 27th. I have not received receipt. Also check is not cashed.
I agree, it is taking too much time, compared to previous applications.

My PD is Nov 2001. It became current last month. Filed 485 this month. Now I see people with 2007 PDs eligible to file. Can't complain. Take it as it comes and proceed. You are not a player in these. You are only a spectator.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

How do you know that this year quota finished on first day because of �Indian Companies�? Do you have any proof to support your blame? And what is �Indian consulting firms�? Why is it ok for one group of companies to file for H1 and not ok for another group of companies to file H1? Why is it �UNFAIR� for consulting companies to take large number of H1 quota? Isn�t H1 considered to be for the �best and the brightest�? Wouldn�t it make more useful for the �best and the brightest� to provide solutions to many companies at the same time by working for consulting companies? Why discriminate against consulting industry?
Here is some information that may help you gauge the reality. There is lot of companies in US that would not fit into your definition of �Indian Companies�. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.
2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that �the changes going to be introduced to fix the system will not screw us and complicate more the immigration process.� is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. Also, I see a racist attitude in this bill against the huge consulting industry. And this negative attitude against consulting industry will have a snow ball effect into rest of the economy and society. I don't think IEEE took that into consideration.

Rules have not changed, lot of folks are fortunate they got this window of opportunity... i have a feb 2003 pd and I'm happy that everyone including folks with 2007 pds have a chance to get out of this mess, i dont want anyone to go through the pain and agony we older PD holders have gone through... go god bless everyone, and friend hang in there... whatever happens happens for good believe in that, your older PD will help you in future you never know, so cheer up think well for others and i m sure someone up above will think well for you (you are one of the fortunate ones to be in this country - compare this to the millions from where you came)

As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.
PLEASE be brief - bullet points would be good.
Also links to articles to support your concerns are welcome. I will put together a package to hand out at the meeting.
