I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.

StuckHere: As a backstop, do you have AP in hand? If yes, my attorney has recommended sending a letter withdrawing your H1-B stamping application to the consulate where you interviewed. Then with a copy of the letter in hand, and with your AP, seek to reenter the US on your own terms... Good luck...

Declaration of M. Cannon filed in one of the civil cases in Northern GA, dated October 4th, 2007. To know for sure you have to have a pending lawsuit and send a discovery request to district US Attorney.

Type in congressman your city name in google or yahoo search. It will give you various names for your senator and congressmen. Call them and give them your name FN LN, DOB, Alien number and fedex / delivery tracking mnumber. They will call you back with relevant information.

Where did you get the A number of the applicant? I checked my I140 approval there is no such number on it in front of Beneficiary name and in the bottom. Even in my I131 application the A number box is blank. Is there any other way to get this A number.

You can't divide the quota into 5 categories. Any country is capped at 7% usage(unless there's a spillover). The ROW EB3 will definitely consume more than the X/5 as it is not a country but a collection of countries, with no country reaching the 7% limit. The only reason there are separate categories in for India, China, Philipines, Mexico are that they are the only countries with demand for more than 7% of the numbers in EB3. In case of EB2, it's only India and China needing more than 7%.

The real message in this thread is that you should check what is required by the countries you intend to transit BEFORE you buy your ticket.
It seems to me that an individual should take responsibility for his own actions rather than trying to blame a particular country for a long established requirement for a transit visa.

If AILA is telling that means there is 50% chance of rumors becoming true. If the rumors are true then State Dept and USCIS mismanaged visa numbers. Anyhow wait and see couple of days

I had my interview for an H1-B at N. Delhi consulate on December the 5th, 2007. The consulate officer told me it needs administrative processing and gave me a pink slip. I was also told that it may take anywhere from few days to 7-8 weeks. Today is February the 8th, 2008, and am still waiting on my visa. So if its any consolation to you stuck_here, I'm stuck here for almost 65 days now. Given that I have a PhD in Chemical Engineering, I might have fallen under the Technology Alert List, but, still, the wait time seems ridiculous. Any ideas from anyone about if there is anything I can do on my part to expedite the matters? Thanks.

There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.
Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)

It's tough to tell. According to processing times on usics.gov, I-90 takes 3.5 months in Nebraska service center. But the form is supposed to be mailed to Phoenix and I could not find any times for the Phoenix office. Since it's a simple correction, I'm hoping a 2-3 week turnaround time but be prepared for a 3+ month wait. If you need to travel, it's better to get an I-551 stamp in your passport so you can travel regardless.

Interesting policy. A lot of companies do not sponser H1b and GC because of the woes, costs and hastles associated with it, though they would love to hire the right kind of candidate. But this company is ready to pass the right candidate just because they have to provide a letter?

We dont really know what their real apprehensions are behind not interested in hiring an EAD person..
It could be that
-- They had bad experiences in past with EAD people going out of status due to delays in EAD renewal
-- They have an impression that EAD people or like cats on walls...you never know when they will jump ship !
-- They dont have nor dont want to invest in having some kind of immigration expert in the company to help out employees. And feel (probably mistakenly) that taking on an EAD person, means to have to support him more than merely providing an emp. letter when required.

Some ideas are good. In order to implement them, we need support from members. Pls volunteer and take up the ideas to lead them. For example I have mentioned about poster and banner campaign. If each one of us, prints them and post them in various places, we can get good publicity.
We have to make do with such low cost volunteer work. Someone pointed out that we should contact newspapers and get articles published. Wish it was so easy. We have written tons of mails but that alone does not work. You need to issue press releases and publish them online. Publishing them each online costs a couple hundred dollars by publishing services who distribute, and there is no guarantee it will be picked up. Thus you need a focussed campaign for it. There are services where you can contact reporters and media on a specific topic and send them email, press release directly. If they are already writing article you can know the deadline. If you have an idea, you can pitch a story idea to the reporter directly. A good service I know costs 5K for non profits for one year. If you need access to International reporters database add 2k to it. All this is possible only if we have these kinds of resources. When we can hardly get contributions of 5k in 4 months after collecting $5 each, it is tough to plan a big media campaign. The reason why other big organizations and big anti immigrant orgs can get so much publicity is that they probably can spend their huge resources on such services. They can also afford a full time staff. We do not have all that and run IV along with our full time day time jobs.
