The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. I have a question about July Visa bulletin. If the August bulletin is retrogressed when announced in mid-July, can the USCIS change rules and stop accepting new Adjustment of status petitions in mid-July ? I know that it sounds illogical and that July bulletin's current dates would apply thru July 31st but I am hearing from my professional colleagues that USCIS could change rules and stop accepting new AOS petitions in middle of the month.
And I got this reply :
Yes, what you raise is quite illogical. The visa bulletin controls which AOS can be filed during the calendar month for which it is published, there is no way for USCIS to stop receiving an AOS application received say on July 16th. AOS is not like an H1B filing, where there is a finite # that must be received by a date certain and then allocated.

Finally I got the email for Renewal EAD card production ordered.
I e-filed on June 11th. Did the finger printing on July 11th. card production prdered on Aug 12th. Still waiting for the card. will update with the validity of the period once i have it in hand.

I thought i was the oldest, but someone got a GC this week after 16 yrs wait. my first attempt was in 1998 sept (never filed and sat in the lawyers office for 6 months) while i was working hard. Second went into NY DOL (2001) and after 4 yrs my company shut down - labor was in backlog center. Last attempt started in 2005. Aug 11th it will be 15 yrs. Not sure what i am doing here or why i am clinging on to this. Hanging in the same field, no growth and no enthu. Most of my friends put up their citizenship oath taking pics in facebook or are back in india

Lets not get stuck in debating and talking all the new news about legislation being introduced, Skil/CIR. The most important thing is to create awareness about problems we are facing (EB immigrants).
Time again we have seen that because of low awareness amongst all the peoples-reps (congressmen, senators, all others) our provisions have been dropped at the last minute.
The need of the hour is to keep working together as a unified team, we all do a good job as a team. We have seen that during the lame duck and also before in May, 2006.
IV core as a team exactly knows what is best for all of us. We have to trust them and help them do their thing, meanwhile we can all concentrate on
1)raising awareness, writing op/eds. writing to editors
2) Inviting other people who are stuck like us (to be IV members). Strength is in the numbers.
3) Creating a huge fund to help lobby/or other such activity that we need it for.
Some new members might doubt the intentions and the commitment of the core team. Also it is very easy to be skeptical of people asking for funds. When I was new to the IV team, I had the intitial skepticism about people on the forum asking for funds and contributing. It took me a good 2 weeks of being a guest on the site to register and then another 10-12 days to give my first contribution. So from that standpoint, I know that new people on the forum are going to take some time to trust IV and have faith in the core leadership. All we can do is to get new members (So many thousands stuck in retrogression). New members inturn will become active in a short time, Bigger and stronger IV with a 10,000+ membership will ensure being noticed and also will have the required funds to make it happen this year.
Lets reach the target of 10000 members before the 31st of this month.

How about we propose to USCIS/DOS to give spillover based on PD and not based on Category. This way EB3-I and EB2-I will move forward steadily without any fuss. I know initially it will help most of EB3-I but once EB3-I catches up with EB2-I then both can move forward together.

The worst injustice USCIS committed was setting up Backlog Elimination Centers and letting an incompetent contractor handle the cases slowly. Elaine Chao must be fired for incompetence and indifference just like Brown was fired for Katrina bungling.
Brown (and Bush administration) don't care about AMERICANS (well, mostly poor blacks but Americans anyway...), while Elaine Chao and her great team don't care for immigrants. Who gives a damn?! She may even get a promotion for this screw up, forcing some immigrants to give up and pack back.

I got 3-year H-1B extension till 09/2010 based on approved I-140 from current employer. Similarly, my wife's H4 status is approved till 09/2010. My wife filed for a new H-1B and her change of status from H-4 to H-1B is still pending (she has a receipt number and got selected in the lottery). Assuming her H-1B approval comes through, the start date will be from 10/01/2007. So far good.
Now, I found a new job and the employer is willing to do the H-1B transfer. My wife's H4 needs extension too. What will happen if her H4 extension comes till 09/2010 with a pending H-1B? What will happen if her H-1B comes before H4 extn?
Is it possible to extend her H4 only till 09/30/2007?

Well I responded in Oct 2008 and it had RFE status. It didnt change for the past 2 years and it changed to "RFE Review" yesterday. Is this just a coincidence or something to extract out of it ?
For RFE rebuttal, it will remain in the same status until it is approved. You should have contacted them after 60 days of your rebuttal. But as of now, it is fine I guess.
My friend had very similar situation. His status remained as REVIEW until it was finally approved. So no need to worry.
